Permanent Residency Status 'The Greencard'

American Citizens may sponsor direct relatives for the purpose of immigration to the United States. American citizens can sponsor the following relatives:

bullet Husband or wife;
bullet Unmarried child under 21 years of age;
bullet Unmarried son or daughter over 21 years of age;
bullet Married son or daughter of any age;
bullet Brother or sister, if the sponsor is at least 21 years of age; or
bullet Parent, if the sponsor is at least 21 years of age;

Lawful permanent residents of the United States, i.e. those residing legally in the United States by nature of a green card, may sponsor the following relatives for immigration to the United States:

bullet Husband or wife; or
bullet Unmarried son or daughter of any age;

Petitioners seeking to bring relatives to the United States are required to prove the existence of a valid relationship. If this relationship exists from marriage, the marriage must have been undertaken in good faith. Relationships not adequately documented or marriages made to circumvent INS regulations will result in immigration failure and constitute fraud.

Applying for a green card is a complex and difficult process. In most cases, applications are approved after years of processing delays.
